Donor Privacy Policy

We value and respect the privacy rights of all individuals who make donations to Project Sunshine (“Donors“). This Donor Privacy Policy governs the collection, use and disclosure of Donor Information, whether such Donor Information is obtained via the Services, mail, in-person or other means. By making a donation to Project Sunshine, you affirmatively consent to this Donor Privacy Policy, our Privacy Policy and Terms and Use (and the practices described therein), which will remain in full force and effect and the terms of which are hereby incorporated into this Donor Privacy Policy as though fully set forth herein. To the extent that there is a conflict between this Donor Privacy Policy and our Privacy Policy or Terms of Use, this Donor Privacy Policy shall govern. Any capitalized terms that are not defined in this Donor Privacy Policy shall have the meaning given in the Terms of Use or Privacy Policy, as applicable

Collection of Donor Information

When you make a donation, whether by phone, email, in person or through the Services, we may collect and use certain Personal Information that you voluntarily provide to us in connection with processing and completing your donation (“Donor Information“).

Any Personal Information that you provide in connection with making a donation through the Payment Services may be collected by a third party operational service providers (e.g., Network for Good, Charity Happenings, Pay Pal, etc.) and all donations made through these third party operational service providers are subject to their respective terms and conditions of use. In the event of a conflict between such third party´s terms and conditions and this Donor Privacy Policy, the terms and conditions of the third party service provider shall govern and control. Project Sunshine has no control over, and shall not be responsible for, any use of information collected through the Payment Services.

Additionally, if you make a donation via the Payment Services or access any of the Services, we may also collect certain other Information from you, such as usage and traffic data. Our collection and use of such Information will be governed by our Privacy Policy and Terms of Use.

Use and Disclosure of Donor Information

  • We will not sell your Donor Information.
  • We may use your Donor Information to process and complete your donation, as well as communicate with you about your contribution.
  • We may send you information or communications about events, programs, upcoming activities and other ways in which you can support Project Sunshine.
  • We may share certain Donor Information with our affiliates, partners, and third party business partners solely as necessary for purposes of completing and processing your donation, verifying your donation and Donor Information, and facilitating the communications described in this Donor Privacy Policy (including, without limitation, creating, printing and addressing Project Sunshine event and fundraiser invitations, newsletters, publications, etc.).
  • We may use your Donor Information for internal business purposes, such as tracking and analyzing our donor data.
  • We may disclose your Information where we have a good faith belief that such disclosure is necessary in order to: (i) protect, enforce, or defend the legal rights, privacy, safety, or property of Project Sunshine and our affiliates and their respective employees, agents and contractors (including enforcement of our agreements and our Terms of Use); (ii) protect the safety, privacy, and security of others; (iii) protect against fraud or for risk management purposes; (iv) comply with the law or legal process, including any financial reporting requirements; and/or (v) respond to requests from public and government authorities.
  • We may retain your Donor Information for the period necessary to fulfill the purposes outlined in this Donor Privacy Policy unless a longer retention period is required or allowed by law.
  • If Project Sunshine sells all or part of its business or makes a sale or transfer of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, Project Sunshine may transfer your Donor Information to the party or parties involved in the transaction as part of that transaction.

Project Sunshine is committed to protecting your Donor Information and we will make reasonable efforts to protect and keep that information secure. However, regardless of our efforts, no one can guarantee the complete safety of your Donor Information. Indemnification; Limitation of Liability

You agree to indemnify, defend and hold Project Sunshine, its affiliates, and their respective successors and assigns, directors, officers, employees, representatives, agents, licensors, suppliers and service providers harmless from any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys´ fees), arising in any way out of or in connection with (a) your breach of any applicable law, rule or regulation, and (b) any claim that your Donor Information and/or Project Sunshine´s use thereof violates any applicable law, rule or regulation or the rights of any third party. Project Sunshine reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you and all negotiations for its settlement or compromise, and you agree to fully cooperate with us upon our request. YOU UNDERSTAND AND AGREE THAT, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, PROJECT SUNSHINE, ITS AFFILIATES, AND EACH OF THEIR RESPECTIVE SUCCESSORS AND ASSIGNS, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AGENTS, LICENSORS, ADVERTISERS, OPERATORS, SUPPLIERS AND SERVICE PROVIDERS, SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, OF ANY KIND, DIRECT OR INDIRECT, IN CONNECTION WITH OR ARISING FROM USE OF THE DONOR INFORMATION OR FROM THIS DONOR PRIVACY POLICY, INCLUDING, WITHOUT LIMITATION, COMPENSATORY, CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES.

Changes to the Privacy Policy

We reserve the right to change this Privacy Policy at any time. When we do, we will note the last update at the top of the policy.
